Terms of service
Last updated October 2, 2026. The agreement between you and us, written to be read, not skipped.
What changed: Rewrote the terms in full: who we are, 18+ eligibility, acceptable use, paid plans and canceling, disclaimers, liability, disputes and governing law.
Who you are agreeing with
These terms are an agreement between you and Ezekiel Madrigal, a sole proprietor who operates PayBrisk (“we”, “us”). You accept them when you tick the box and create an account. Our privacy policy, refund policy and cookie policy are part of them.
Who can use it
You must be at least 18, able to make a binding agreement, and using PayBrisk for your own selling or business. PayBrisk is offered to people in every US state.
What PayBrisk is
PayBrisk is a free software tool that shows your customers the ways you already get paid, such as Cash App, Venmo, Zelle, PayPal, Square and cash, on your own page and on the bills you make. It is not a bank, a payment processor or a party to the work you are billing for. Money goes from your customer to you through the app they choose, and never through PayBrisk.
Your account
You sign in with a link sent to your email address, so keep that mailbox secure — anyone who can read it can sign in as you. You are responsible for everything done through your account and for the accuracy of every bill you send. Give us a real email address and keep it up to date, and tell us at support@paybrisk.app if you think someone else has used your account.
Getting paid
If you are paid in cash or through your own Cash App, Zelle, Venmo, PayPal or Square details, PayBrisk displays those details on your bills and records what you tell it was paid. It neither receives nor verifies any of that money, and a bill is marked paid on your word alone.
Each of those apps has its own terms, and some do not allow a personal account to be used for selling. Using the kind of account your app requires for business, and keeping to its rules, is up to you.
Your pay link
You choose the name in your own pay link, such as paybrisk.app/yourname. You may not choose one that passes you off as somebody else, as another business, or as PayBrisk itself. If a name does that, or is chosen to stop somebody else from using their own, we can ask you to change it or take it back and give it to the business it belongs to. We will tell you if we do.
A name you stop using is kept for you rather than released: it forwards to your new link, so anything you have already printed or handed out keeps working, and nobody else can take it. Because each change puts a name beyond everyone’s reach for good, you can change yours once every 30 days. Taking back a name you used before does not count against that, and you can write to support@paybrisk.app if you need another change.
Acceptable use
You agree not to use PayBrisk to:
- break the law, or sell anything illegal where you or your customer are;
- mislead or defraud anyone, or bill for something you did not provide;
- pass yourself off as another person or business, or as PayBrisk;
- send spam, or collect other people’s details without a reason to have them;
- upload anything that infringes somebody else’s rights, or is hateful, threatening or sexual;
- probe, overload or get around the security of the service, or scrape it with automated tools.
Your content
What you put into PayBrisk, such as your name, logo, items, prices and bills, stays yours. You give us permission to store, copy and show it only as needed to run the service for you, for example to display your page to your customers and print your sign. That permission ends when you delete it or your account, except for copies we must keep as the privacy policy describes. You confirm you have the right to use what you upload.
What you can bill for
You may bill for lawful goods and services you have actually provided. We refuse to create a bill in a category that payment providers treat as elevated risk, because it puts your accounts with them at risk. That includes cryptocurrency, firearms, adult services, gambling and similar categories. A single invoice may not exceed $2,500.00.
Fees
PayBrisk is free. There is no fee on what you are paid, no paid plan and no limit on how many bills you make. If we ever offer paid features, we will tell you first, and nothing will be charged unless you choose it and agree to its price and renewal terms at that time.
Refunds and disputes
Because the payment is yours, a refund to your customer is yours to give, through the same app they paid with. Disputes are between you, your customer and that app, under its rules. We will help you find the records for a bill, but we cannot move money we never held.
Availability
We work to keep PayBrisk running, but we do not promise it will be available without interruption. We may change or discontinue features, and we will give reasonable notice before removing anything you depend on.
Ending this agreement
You may stop using PayBrisk at any time and delete your account yourself from the bottom of your dashboard, or ask us to do it. We may suspend or close an account that breaks these terms, is used for fraud, or puts other people at risk. If we close your account, existing pay links stop working; payments already completed are unaffected.
Disclaimers
PayBrisk is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms, including any implied promise that it is fit for a particular purpose or free of errors. We do not check that a customer actually paid you, and nothing on PayBrisk is tax, legal or financial advice.
Limit of liability
To the extent the law allows, we are not liable for lost profits, lost sales, lost data or any indirect or consequential loss, and our total liability to you for any claim is limited to the greater of what you paid us in the twelve months before the claim and $100. Nothing in these terms limits liability that the law does not allow to be limited, such as for fraud or gross negligence.
Indemnity
If somebody makes a claim against us because of what you sold, what you put on your page or bills, or your breaking these terms or the law, you agree to cover our reasonable costs of that claim. This does not apply to the extent the claim is caused by our own fault.
Changes to these terms
When these terms change, the date at the top changes and the “What changed” line says how. For a change that affects your rights or what you pay, we tell you in your dashboard and by email before it takes effect. If you do not agree, you can stop using PayBrisk and delete your account; continuing to use it after the change takes effect means you accept it.
If something goes wrong
Please write to us first at support@paybrisk.app and tell us what happened and what you would like us to do. We will try to sort it out within 30 days. Most problems end there.
If they do not, either of us can take the dispute to court. These terms are governed by the laws of the State of California, without regard to its rules on conflicts of law. If you use PayBrisk as a consumer, you also keep the protection of the laws of the state where you live and can bring a claim in your local courts. Small claims court is always available for claims that qualify. These terms contain no arbitration agreement and no class action waiver.
General
- These terms and the policies they link to are the whole agreement between us about PayBrisk.
- If a court finds part of them unenforceable, the rest still applies.
- If we do not enforce a term right away, we can still enforce it later.
- You may not transfer this agreement without our permission. We may transfer it to whoever takes over PayBrisk, and will tell you if we do.
- We are not responsible for delays caused by things outside our reasonable control, such as an outage at one of our providers.
- We send notices to the email address on your account. You can send notices to support@paybrisk.app.
